moonlight-highway-1139044-mA preliminary investigation did not seem to indicate that the driver was under the influence or otherwise impaired during the accident. The driver explained that because of the dark he was not able to see the woman crossing the road until he was at the point where he could not avoid the accident. An accident investigation/reconstruction team was called to investigate and determine the details of the accident. The team did not find any evidence that the truck driver was speeding. Currently, no charges are being pressed against anyone.

Suing Municipalities in Georgia

Although many people commonly think of personal injury suits in terms of suing individuals, it is possible that entities, organizations, and even municipalities can be sued. This of course depends on the specific circumstances of the injury at issue, but it is possible that in a situation similar to the one above the victim’s family may consider bringing a suit against the county.

To bring an injury suit against the county, the victim would need to meet the same requirements as if they were bringing the suit against an individual. Using an example similar to the situation above, the victim’s family would first need to establish that the city owed them a duty to maintain the road in a safe manner. The victim’s family could argue that the city should have ensured that the street and crossing had brighter lights or a clear pedestrian walkway. They then would need to prove that the city breached its duty because neither of those things was in place. Lastly, they would need to establish that they suffered actual injuries and damages because of the city’s negligence.

Personal injury cases can always be complicated, but when a city or municipality is involved it can become exponentially more difficult. This is because the city will most certainly have skilled attorneys to defend it, and it often has a series of defenses when it comes to these sorts of claims, including potential immunity from lawsuits. In order to counter its defenses, an attorney’s expertise is indispensable.
